Toyota Facing Lawsuits Due to Defects

On September 27, 2010, in Auto Accident, Personal Injury, by K. Lindsay Rakers

Toyota Motor Corp. has recalled approximately eight million vehicles due to defects with the accelerators malfunctioning and forcing vehicles to speed off out of control, causing motorist injuries and deaths. As a result of these injuries and deaths, consumers are filing numerous lawsuits against Toyota.

The massive recall has affected Corolla, Camry, Avalon, and Tundra. The recall also prompted Toyota to halt production of thesemodels until the defective pedals can be repaired or replaced. The lawsuits aren’t waiting. Individuals are claiming theirToyota and Lexus vehicles suddenly accelerated or otherwise malfunctioned. In the past three months alone, there have been at least 10 lawsuits filed seeking class-action status against Toyota in the U.S. and Canada, officials said.

The lawsuits accuse Toyota and others of negligence for designing, making, and marketing defectively dangerous gas pedals in millions of cars and trucks. The suits also allege Toyota violated its duty to warn consumers about the defects. The claimants seek compensatory damages for medical bills and other out-of-pocket expenses associated with the defective car parts. They also seek to enforce punitive damages to punish Toyota for selling the cars and trucks even though they knew they were dangerous.
